Law is an essential tool for improving public health infrastructure and outcomes; however, existing state statutory public health laws may be insufficient. Built over decades in response to various diseases/conditions, public health laws are antiquated, divergent, and confusing. The Turning Point Public Health Statute Modernization National Collaborative addressed the need for public health law reform by producing a comprehensive model state act. The Act provides scientifically, ethically, and legally sound provisions on public health infrastructure, powers, duties, and practice. Various pedagogical methods are used to expose business students to real-world ethical dilemmas, yet students may not readily grasp the linkages between ethical theories and dilemmas to identify possible ethical solutions. Venn diagrams are a valuable instructional tool in business ethics classes when used with other teaching methodologies such as case studies. We describe how the use of Venn diagrams assists (...) students in visualizing the key points of and the connections between ethical theories and dilemmas to shed light on possible ethical solutions. Examples of teaching exercises are provided along with ideas for future research in the use of Venn diagrams in activating moral imagination and improving ethical reasoning. In another tumultuous term of the United States Supreme Court in 2022-2023 a series of critical cases implicate instant and forthcoming changes in multiple fronts that collectively shift the national public health law and policy environment.

Among the morass of critical issues impacting the results of the midterm elections in 2022 were core public health issues related to health care access, justice, and reforms. Collectively, voters’ communal health and safety concerns dominated outcomes in key races which may shape national, state, and local legal approaches to protecting the public’s health in the modern era.

Many strands are woven into the ideas and work of Jeffrey Gray. From a background of classical languages and a spell in military intelligence spent honing skills in languages and typing, he took two BA degrees (in modern languages and psychology) at Oxford University. He then trained as a clinical psychologist at the Institute of Psychiatry (IOP), London, capping this with a PhD on the sources of emotional behaviour.

As the United States emerges from the worst public health threat it has ever experienced, the Supreme Court is poised to reconsider constitutional principles from bygone eras. Judicial proposals to roll back rights under a federalism infrastructure grounded in states’ interests threaten the nation’s legal fabric at a precarious time. This column explores judicial shifts in 3 key public health contexts — reproductive rights, vaccinations, and national security — and their repercussions.

Protecting the public's health has recently regained prominence in political and public discussions. Threats of bioterrorism following September 11, 2001 and the deliberate dissemination of anthrax later that fall, the reemergence of novel or resurgent infectious diseases, and rapid increases in diseases associated with sedentary lifestyles, poor diets, and smoking have all raised the profile of public health. The U.S. government has responded with increased funding, reorganization, and new policies for the population's health, safety, and security. It will introduce the thinking of Lévinas (1905-96) to bring into focus the differences entailed in addressing ethical contexts from various perspectives of time, whether in terms of past experience, present contingencies, or considerations of the future. It turns out to be necessary to distinguish between various conceptions of the future as well, in order to grasp the different construals of constraints on moral deliberation. A contrast may be drawn between the individualism and the collectivism, [End Page 107] respectively, of Nietzsche's and Heidegger's visions of the future;1 and between the religious determinacies of Lévinas's invocation of futurity and Derrida's more ascetic, formally indicative recasting of Lévinas's à-dieu.2 It is also the case that distinct conceptions of the past impose significant constraints on what human beings can hope to achieve in their moral efficacy. There is an important difference between the Greco-pagan past, invoked by Nietzsche and Heidegger, and the divine time of creation invoked in the opening pages of Genesis, which is the source of Lévinas's notion of an immemorial time, and which is subjected to deconstructive reading by Jacques Derrida in "The Animal Which Therefore I Am, to Be Continued" [see Derrida, "L'animal autobiographique"].I shall introduce a reading of the second part of Kant's treatise The Conflict of the Faculties (1798) [139-71], on the contest between philosophy and law, to suggest that for ethics, by contrast to concerns with aesthetics, metaphysics, and epistemology, a consideration of conceptions of futurity is especially pressing. This provides a context for responding to Lévinas's early article "Reflections on the Philosophy of Hitlerism" (1934), to which Lévinas wrote an introduction, including my opening citation, some sixty years later.3 Lévinas is not simply engaging with the problem of evil, in relation to the now well-known moral deficiencies of Heidegger's fundamental ontology.4 He is also warning, more generally, against delusions arising from theoretical abstraction, in both absolute idealism and, indeed, in a Nietzschean ethics. The latter half of the twentieth century has been marked by debates in evolutionary biology over the relative significance of natural selection and random drift: the so-called “neutralist/selectionist” debates. Yet John Beatty has argued that it is difficult, if not impossible, to distinguish the concept of random drift from the concept of natural selection, a claim that has been accepted by many philosophers of biology. If this claim is correct, then the neutralist/selectionist debates seem at best futile, and at worst, (...) meaningless. I reexamine the issues that Beatty raises, and argue that random drift and natural selection, conceived as processes, can be distinguished from one another. (shrink)

As past president of both the History of Science Society and the American Society of Church History, Ronald L. Numbers is uniquely qualified to assess the historical relations between science and Christianity. In this collection of his most recent essays, he moves beyond the clichés of conflict and harmony to explore the tangled web of historical interactions involving scientific and religious beliefs. In his lead essay he offers an unprecedented overview of the history of science and Christianity from the perspective (...) of the ordinary people who filled the pews of churchesor loitered around outside. Unlike the elite scientists and theologians on whom most historians have focused, these vulgar Christians cared little about the discoveries of Copernicus, Newton, and Einstein. Instead, they worried about the causes of the diseases and disasters that directly affected their lives and about scientists preposterous attempts to trace human ancestry back to apes. Far from dismissing opinion-makers in the pulpit, Numbers closely looks at two the most influential Protestant theologians in nineteenth-century America: Charles Hodge and William Henry Green. Hodge, after decades of struggling to harmonize Gods two revelationsin nature and in the Biblein the end famously described Darwinism as atheism. Green, on the basis of his careful biblical studies, concluded that Ussher's chronology was unreliable, thus opening the door for Christian anthropologists to accommodate the subsequent discovery of human antiquity. In Science without God Numbers traces the millennia-long history of so-called methodological naturalism, the commitment to explaining the natural world without appeals to the supernatural. By the early nineteenth century this practice was becoming the defining characteristic of science; in the late twentieth century it became the central point of attack in the audacious attempt of intelligent designers to redefine science. Numbers ends his reassessment by arguing that although science has markedly changed the world we live in, it has contributed less to secularizing it than many have claimed. Taken together, these accessible and authoritative essays form a perfect introduction to Christian attitudes towards science since the 17th century. (shrink)

We review the relation between spacetime geometries with trace-torsion fields, the so-called Riemann–Cartan–Weyl (RCW) geometries, and their associated Brownian motions. In this setting, the drift vector field is the metric conjugate of the trace-torsion one-form, and the laplacian defined by the RCW connection is the differential generator of the Brownian motions. We extend this to the state-space of non-relativistic quantum mechanics and discuss the relation between a non-canonical quantum RCW geometry in state-space associated with the gradient of the quantum-mechanical expectation (...) value of a self-adjoint operator given by the generalized laplacian operator defined by a RCW geometry. We discuss the reduction of the wave function in terms of a RCW quantum geometry in state-space. We characterize the Schroedinger equation in terms of the RCW geometries and Brownian motions. Thus, in this work, the Schroedinger field is a torsion generating field, both for the linear and non-linear cases. We discuss the problem of the many times variables and the relation with dissipative processes, and the role of time as an active field, following Kozyrev and a recent experiment in non-relativistic quantum systems. We associate the Hodge dual of the drift vector field with a possible angular-momentum source for the phenomenae observed by Kozyrev. (shrink)

Recently, much philosophical discussion has centered on the best way to characterize the concepts of random drift and natural selection, and, in particular, whether selection and drift can be conceptually distinguished (Beatty, 1984; Brandon, 2005; Hodge, 1983, 1987; Millstein, 2002, 2005; Pfeifer, 2005; Shanahan, 1992; Stephens, 2004). These authors all contend, to a greater or lesser degree, that their concepts make sense of biological practice. So it should be instructive to see how the concepts of drift and selection were distinguished (...) by the disputants in a high-profile debate; debates such as these often force biologists to take a more philosophical turn, discussing the concepts at issue in greater detail than usual. Moreover, it is important to consider a debate where the disputants are actually trying to apply the models of population genetics to natural populations; only then can their proper interpretations become fully apparent. (Indeed, I contend that some of the philosophical confusion has arisen because authors have considered only the models themselves, and not the phenomena that the models are attempting to represent). A prime candidate for just such a case study is what Provine (1986) has termed “The Great Snail Debate,” that is, the debates over the highly polymorphic land snails Cepaea nemoralis and C. hortensis in the 1950s and early 1960s. These studies represent one of the best, if not the best, of the early attempts to demonstrate drift in natural populations. (shrink)

The food supply of the temperate lands of early-medieval western Europe, and the ways in which its peoples dealt with the central problem of feeding themselves, has been subjected to a variety of interpretations in recent years. Vern Bullough and Cameron Campbell's study of the medieval diet and female longevity concluded that early-medieval women suffered from iron deficiencies triggered jointly by poor nutrition and frequent childbearing and that these deficiencies contributed substantially to their average early age of death. Ann Hagen's (...) overview of Anglo-Saxon patterns of food production and consumption suggested that most of the early English population routinely lived at marginally adequate or outright substandard levels of nutrition. Similar conclusions were reached by Renée Doehaerd in her study of the early-medieval economy. Michel Rouche, on the other hand, asserted that the typical Carolingian—including the peasants—had access to a monotonous, but abundant, supply of foodstuffs and may have consumed an average of 6,000–9,000 calories per day. Richard Hodges likewise decided that Anglo-Saxon peasants were reasonably well fed, based on the heavy food rents per hide demanded during the reign of the West Saxon king Ina. (shrink)

In this paper, I develop an interest-relative theory of justification in order to answer the question, “How can I maintain that P when someone whom I consider to be my epistemic peer maintains that not-P?” The answer to this question cannot be determined by looking at evidence alone, I argue, since justification cannot be determined by looking at evidence alone. Rather, in order to determine whether a subject S is justified in believing that P at time t, we need to (...) assess her evidence in favour of P in proportion to her interest in P.
